Use of Buses by Outside Groups

In New York State, the leasing of school buses to outside groups is primarily governed by Education Law ยง 1709(25)(b). This provision allows school districts that own their own bus fleets to lease buses to other school districts, boards of cooperative educational services, county vocational education and extension boards, or Indian tribes for educational purposes when the buses are not needed for their own transportation needs.
Additionally, the law permits the leasing of school buses to other entities, such as youth service projects, recreation projects, or youth bureaus, under specific conditions. These conditions include that the projects or activities must be authorized and approved by the state youth commission or fall under certain categories outlined in the General Municipal Law.
However, the law does not explicitly authorize the leasing of school buses to outside groups for non-educational purposes. Therefore, unless the outside group is engaged in an educational activity or falls within the specified categories, leasing school buses to such groups may not be permissible under New York State Education Law.
It's important to note that any leasing agreements must comply with all applicable regulations, including those related to insurance and safety standards. For instance, when leasing school buses, the lessee is responsible for providing public liability and property damage insurance, fire insurance, and compensation insurance for drivers. The additional cost of such insurance is to be paid by the lessee.
